DMCA Copyright Policy

Overview

HireCharacter respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to clear notices of alleged copyright infringement.

Our Policy

It is our policy to:

  • Respond to clear notices of alleged copyright infringement
  • Take appropriate action under the DMCA and other applicable intellectual property laws
  • Terminate the accounts of repeat infringers when appropriate

Filing a DMCA Notice

If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following information:

Required Information for DMCA Notice
  1. Identification of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notice, a representative list of such works.
  2. Identification of the material that you claim is infringing and that you request to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as the URL or specific location on our platform).
  3. Your contact information, including your address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature or the signature of a person authorized to act on behalf of the owner of the copyright interest.

How to Submit a DMCA Notice

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or disabled and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the US, for any judicial district in which HireCharacter may be found), and that you will accept service of process from the person who provided the original DMCA notice

False Claims

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Don't make false claims!

Repeat Infringers

HireCharacter will terminate user accounts that are the subject of repeated DMCA takedown notices or other repeated copyright infringement claims or that otherwise repeatedly infringe the copyrights of others.

Response Time

We aim to respond to valid DMCA notices within 5-7 business days. Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material
  • Provide the user with a copy of the DMCA notice
  • Inform the user of their right to file a counter-notification

  • We may forward your DMCA notice to the user who posted the allegedly infringing material
  • We may post DMCA notices and counter-notifications at our discretion
  • This policy applies only to copyright infringement claims under the DMCA
